The Problem(s)


 

THOSE OF US ALIVE BUT WOUNDED,  ARE FORGOTTEN, For THE WOMEN WHO HAVE CERTAIN "UNACCEPTABLE WOUNDS." THERE ARE NO  GROUPS OF SUPPORT, CROWDS PRAISING OUR  EFFORTS TO COPE OR OUR HONORABLE SERVICE!


Part of the problem for some lies in the ferres doctrine law which says that if a woman is assaulted, its too bad, there is no recourse outside the military court! That is if your case makes it to the military court in the first place and isn't covered up or tossed aside. 

 The Supreme Court has ruled that women cannot sue for tort claim in a civil court in cases where violence is perpetrated against them, yet conviction rates in the military allow most offenders to go free or serve minor sentences and there is no recourse for appeal! Women can be heard to say over and over "It's not just me!" Transfer is common, letters in the womans files, trumped up charges, and referrals to mental health for failure to adjust to military life discharges.

 Others who did report were dismissed and their reports covered up, nothing done to the perpetrators who went on to continue his wrongdoing. police reports were destroyed or "lost" records found missing. this is heard over and over.

There is a statute of limitation of five years on reporting. Women in the 70's and 80's who were abused had no means of reporting and no one to tell. Due to the insistence of reporting to ranking officers that were often themselves the perpetrators, this is and was a ridiculous practice.

One of Diane's perpetrators stayed in the civil service another 20 years after her service at the very same base over the same area! To add insult to injury many of these same perpetrators having avoided detection in the service now serve in systems like the VA or DAV and women have to deal with some of them there. This should not be!

Our government orders endless "task forces" to "study" the "problem" when two female Generals in 1972 and again in 1975 discussed it as a crime!

One female columnist has been quoted saying enough has been done and we women cannot even tolerate a touch on the arm.We are not talking about touches on the arm here! We're talking lifelong scars with no sense of duty, only degradation and humiliation. This tendency to minimize is not helpful.

FROM 1999 UNTIL 2005 THERE WERE ONLY  4 CASES...FOUR CASES...OF PTSD-SEXUAL TRAUMA OUT OF 453067 CASES HEARD BY THE VA COURT OF APPEALS! ALL WERE DENIED! WHAT AN OUTRAGE! WHAT A MOCKERY! OUR FORMER HOUSE OF REPRESENTATIVES DID NOT THINK THIS AGENCY NEEDED HEAVY OVERSIGHT?

FINALLY THE SENATE HAD BEGUN CALLING INTO ACCOUNT THE VA QUARTERLY FOR THEIR BACKLOG OF CLAIMS STUCK IN THE COURT OF APPEALS. WE ARE GRATEFUL FOR THEIR EFFORTS. WILL THE NEW CONGRESS CONTINUE HEAVY OVERSIGHT? WE ARE WATCHING...


Why doesn't she just get over it?" we hear others say. Some of us never get over hurting, dying, grieving, and being angry about evil! The lifetime of pain given by those who go on to forget what they did, only to leave us to fight daily battles.  What a shame to hear stories of 5, 10, and 20 years waiting for restitution from the VA for something that wasn't your fault in the first place. That's not fair! That's not just!

NOW IRAQ CONTRACTORS ALSO FALL UNDER THE FERES DOCTRINE. DON'T EXPECT CURRENT JUDGES TO NULLIFY IT!


Assault can happen to anyone. It is an act of violence. It is neither instinctual or natural! It is aberrant behavior! drugs or alcohol are frequently involved.

There is no justice for women in the UCMJ for this crime. The time for studies has ended! pUT MILITARY SEXUAL CRIMES UNDER FEDERAL LAWS WITH TORT!

MAKE THIS CRIME A TRIAL BY JURY OF OUR PEERS, NOT A JOKE OF A JURY.

THERE ARE CLOSE TO 10,000 SIGNATURES ASKING OUR REPRESENTATIVES TO ABOLISH FERES DOCTRINE. NOW IS THE TIME TO QUIT ACTING LIKE A THIRD WORLD COUNTRY WITH OUR WOMEN IN THE MILITARY.

TAKE THIS CRIME OUT OF THE HANDS OF THE MILITARY. tHEY WILL NOT POLICE THEIR OWN.
 INSIST ON TRIAL OF JURY BY PEERS NOT HAND PICKED MALE MILITARY JURIES.
 WOMEN NEED THE PROTECTION OF FEDERAL LAW AND THERE SHOULD NOT BE A STATUTE OF LIMITATION ON THESE COVER-UP CRIMES.
